Our Services

The SM Records Ltd provides services including but not limited to:

Availability of specific services may vary by territory and Digital Service Provider (DSP).

Content Ownership

You retain ownership of your copyrights. By submitting content, you grant The SM Records Ltd a non-exclusive, worldwide license to:

your content solely for the purpose of providing our services. This license terminates when your content is fully removed from all supported DSPs, subject to contractual obligations.

Rights & Warranties

You represent and warrant that:

• You own or legally control all copyrights.
• The content does not infringe any third-party rights.
• Necessary licenses have been obtained.
• Metadata is accurate.
• No fraudulent ownership claims exist.
• The content complies with all applicable laws.

Content Review

The SM Records Ltd reserves the right to review any submission before or after distribution. We may reject, suspend, remove, delay, or disable content where there is reason to believe it:

• infringes copyright;
• contains misleading metadata;
• impersonates another artist or label;
• involves fraudulent streaming or manipulation;
• includes prohibited, illegal, or harmful material;
• violates DSP policies or applicable laws.

Our review decisions are made to protect artists, rightsholders, DSP partners, and the integrity of our platform.

Artificial Intelligence (AI) Content

AI-assisted content may be accepted where all applicable rights are properly cleared. We may reject or remove content that appears to rely on unauthorized datasets or otherwise fails to meet our content standards or DSP requirements.

Royalties

Royalties are reported only after they are received from DSPs. The SM Records Ltd:

• does not guarantee revenue;
• cannot control DSP royalty calculations;
• is not responsible for DSP reporting delays;
• may withhold payments where fraud, disputes, legal obligations, or contractual requirements apply.

Payment

Payments may be withheld if:

• ownership is disputed;
• fraudulent activity is suspected;
• copyright documentation is requested but not provided;
• DSPs withhold revenue;
• government or legal requirements apply.

Takedown Requests

Users may request content removal through the designated process. Removal timelines depend on individual DSP processing times. The SM Records Ltd cannot guarantee immediate removal from every platform.

Fraud Prevention

We maintain strict anti-fraud measures. Accounts may be suspended or terminated for:

Any unpaid royalties connected with fraudulent activity may be withheld pending investigation.

Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice where necessary to protect our platform, partners, or legal obligations.

Intellectual Property

All trademarks, logos, software, website design, graphics, branding, and proprietary technology of The SM Records Ltd remain our exclusive property. No license is granted except as expressly stated.

Privacy

Our collection and processing of personal information are governed by our Privacy Policy.

Disclaimer

Services are provided on an "AS IS" and "AS AVAILABLE" basis. The SM Records Ltd makes no guarantee regarding:

• uninterrupted service;
• specific distribution dates;
• editorial playlist placements;
• streaming performance;
• revenue levels;
• DSP acceptance.

Limitation of Liability

To the fullest extent permitted by law, The SM Records Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business opportunities, goodwill, or data.

Third-Party Services

Our services interact with third-party platforms including DSPs and social media services. We are not responsible for their actions, policies, algorithms, reporting schedules, or technical issues.

Changes to These Terms

We may update these Terms from time to time. Continued use of our services constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
